EQUINOX POLICIES

The following policies apply to all members, guests, vendors, and visitors of Equinox Fitness Clubs, Equinox Sports Clubs and E by Equinox (each a “Club”). These guidelines help ensure a safe, respectful, and exceptional experience for everyone, so please read them carefully. Under your Membership Agreement or other agreement and/or terms required to gain entry to a Club, and/or by your use of any Club, you are responsible for complying with all Equinox policies, including without limitation those outlined in this document, and Equinox reserves the right to enforce these policies at its discretion and may suspend or terminate your access for violations.
The following policies apply to all members, guests, vendors, and visitors of Equinox Fitness Clubs, Equinox Sports Clubs and E by Equinox (each a “Club”). These guidelines help ensure a safe, respectful, and exceptional experience for everyone, so please read them carefully. Under your Membership Agreement or other agreement and/or terms required to gain entry to a Club, and/or by your use of any Club, you are responsible for complying with all Equinox policies, including without limitation those outlined in this document, and Equinox reserves the right to enforce these policies at its discretion and may suspend or terminate your access for violations.

Check-In: You are required to check in at the front desk upon entry to any Club and, to access and use the Club, to display your mobile app barcode or other access and identification method made available by Equinox. If you leave and re-enter a Club you will need to check back in with the front desk.

Identification: You may be required to maintain a photo and copy of your photo identification on-file with Equinox in order to verify your identity before entering any Club. If you do not have a photo on file, you must show photo identification at the time of each check-in.

Good Standing: You may be prohibited from accessing and entering any Club if there are any outstanding past-due/overdue amounts payable to Equinox, or your membership is otherwise not in good standing.

Compliance with Club Hours: You are required to comply with the Club’s posted hours of operation, and any additional instructions provided by Equinox. Use of a Club must cease in advance of closing, and you are required to fully vacate the premises by the designated closing time, or earlier if instructed by Equinox.

Personal Conduct: Members and guests must treat others with respect and maintain appropriate behavior while in the Club. Harassment, threats, discrimination, aggressive conduct, or other disruptive behavior toward members, guests, or staff will not be tolerated and may result in removal from the Club or termination of membership. Equinox upholds its personnel to the highest standards of professionalism and expects the same in return from you. If you make any inappropriate or sexually suggestive remarks or advances, your ancillary service sessions and/or treatments and your membership and/or access will be terminated immediately and Equinox may, in its discretion, permanently terminate your membership or ability to access such services, or take other action it deems appropriate. Permanent termination constitutes a lifetime ban from membership and accessing any Clubs and prohibits any future reenrollment at any Club in the future.

Inclusivity: Equinox strives to provide a supportive, respectful, and inclusive environment for all members, employees, vendors, and guests and we expect those in our Clubs to do the same.

Weapons: Firearms and other weapons of any kind are prohibited in all Clubs, to the fullest extent permitted by applicable law, regardless of any permit, license, or authorization to carry. For purposes of this policy, “weapons” include firearms, knives, and any other item intended to cause harm or that could reasonably be used as a weapon.

Any individual who brings a weapon onto Club property may be asked to immediately remove the item from the premises or leave the Club. Failure to comply may result in removal from the premises, suspension or termination of membership, and any other action permitted by law.

Restricted Substances: Our Clubs are drug-free and smoke-free, including vaping. You are expected to help maintain a safe and healthy environment in our Clubs. Use of any Club, including equipment, personal training sessions, spa treatments, events, activities, and other programs, is strictly prohibited while under the influence of any substance that impairs your safe participation. If alcohol is offered by Equinox or one of its approved vendors, you must be at least twenty-one (21) years of age with valid identification to consume alcohol. It must remain in designated areas, and the use of the Club for fitness or spa-related purposes after consuming alcohol is not permitted.

Cell Phone, Camera, and Other Device Use: Recording or photography is prohibited in private areas, including locker rooms, saunas, steam rooms, spa treatment rooms, Kids Club, pool areas, and during group fitness classes. Photography in other areas of the Club is permitted only for personal use and must not capture other members, guests, or staff without their permission. Photography or recording for commercial purposes, including promoting personal businesses or services, is not permitted. Lighting equipment, tripods, or other professional equipment are not allowed. You may be asked to remove content that captures another individual without their permission.

Personal Media Use: As a courtesy to others, all audio and video content must be played through headphones at all times. Volume levels must remain inaudible to others to ensure a respectful and disturbance-free environment. Video or voice calls are prohibited in in private areas, including locker rooms, saunas, steam rooms, spa treatment rooms, Kids Club, pool areas, during group fitness classes, and on the Club floor. For your convenience, voice and video calls may be taken in lounge or lobby spaces so long as they are not on speaker mode or disruptive to others in the Club, as determined by Equinox in its sole discretion.

Locker Room Access: All individuals are welcome to use the locker room associated with the gender they identify as or with which they feel most comfortable, except as prohibited by state or local law. Any person who prefers more privacy for themselves may instead use a single-occupancy restroom, if available.

Lockers; Laundry Service: Lockers and laundry are provided solely for your benefit and convenience and there is no guarantee of availability for either service. You are responsible for locking your locker and may be required to provide your own lock. Storage of illegal substances in any locker is strictly forbidden and punishable by law. To the maximum extent permitted by law, Equinox will not be liable for the loss or theft of, or damage to, any personal property left in any locker. Furthermore, Equinox is not liable for any loss of or shrinkage or damage to your items while being laundered. Lockers and laundry services, including laundry valet, may not be placed on freeze. Overnight Lockers and Laundry Services (each defined below) require a signed Locker & Laundry Agreement, and such services will immediately terminate upon the cancellation or termination of your Membership Agreement. Equinox reserves the right to search any locker without notice in its sole discretion.

  • Daily Lockers: Equinox will remove and discard any articles left in a locker overnight.

  • Overnight Lockers: Certain lockers may be rented for an additional, non-refundable fee, or are included as a member benefit in your Membership Class (collectively, “Overnight Lockers”). For clarity, Overnight Lockers include executive lockers. Overnight Lockers that are included in your existing Membership Class will terminate if you downgrade to another Membership Class.

  • Laundry Service(s): Members may obtain laundry service(s) for an additional, non-refundable fee, subject to the terms and conditions set forth in the required Locker & Laundry Rental Agreement. Laundry Service includes the laundering of one (1) set of clothes in a twenty-four (24) hour period, and is limited to athletic shorts, shirts, leggings, socks, athletic supports, leotards and tights; no shoes will be laundered and such item(s) will be delivered and placed inside the member’s Overnight Locker, which requires Equinox to unlock and access the locker (“Laundry Service”). Laundry valet is Laundry Service that excludes delivery to a locker and may not be available at all locations.

Steam Room and Sauna: You are expected to help maintain a respectful environment in the steam room and sauna. Cell phones, cameras, recording devices, electronic devices, used workout clothing, workout or street footwear, grooming products, and food are not permitted in the steam room and sauna.

Shower, Steam Room, and Sauna Scheduled Closures:Showers, steam rooms, and saunas may be closed at certain times of the day for routine maintenance. Access will not be permitted during these times, and you may be asked to exit these amenities. To advise you of the times in which these amenities may be closed, signs may be posted, or Club employees may notify those in the area or over the Club’s sound system. Showers close fifteen (15) minutes prior to the Club’s closing time; plan accordingly to ensure you are able to exit the Club by closing time. Entry to the showers will not be permitted during the final fifteen (15) minutes before Club closing.

Dress Code: You are required to wear appropriate athletic attire, including tops and footwear, when in any Club, using any equipment and participating in any group fitness class, training session or other activity. In certain group fitness classes, such as yoga, the instructor may require you to remove footwear for the class as a condition of participation. It is strongly recommended that you wear cycling shoes when using the bikes in our cycling studios and certain bikes in our Clubs. Cycling shoes or cleats should not be worn outside the cycling studio. If you have questions on appropriate cycling shoes or compatible cleats, please contact your General Manager. Appropriate swimwear and swim caps are required to enter and use Club pools, cold plunges, hot tubs and other hydrotherapies and amenities, consistent with state and local regulations. Equinox may deny you use of its Clubs if you do not wear proper attire and footwear, as determined in Equinox’s sole discretion.

Equipment: You are expected to use equipment as it is intended to be used and return it to its proper place when finished. Some equipment may be reserved for group fitness classes, and you may be asked to move from this equipment during certain times. You may not reserve equipment for your personal use. As a courtesy to other members, it is expected that you allow others to work in between sets. Please refrain from dropping weights to respect those around you. If you have questions on equipment, please contact your General Manager.

Group Fitness Classes: Certain group fitness classes are included in your Membership Class, these classes require advance booking and reservation, and you will not be permitted to participate in these classes unless you have properly booked and reserved your spot. You may book one (1) class online per class category per day. Equinox may give away your reserved spot if you are not in the class at class start time. If you book online (including through our mobile app), you may cancel a booked class up to five (5) minutes before the class starts. If you do not cancel within this allotted time period or check in by the start of class, you will be considered having “missed” your booked class. If you miss three (3) bookings within a thirty (30) day period, you will be prohibited from booking classes online for a period of seven (7) days. Please avoid entering a class late or leaving a class early, as this is disruptive to other members’ experience. Please do not bring personal items that are not needed for class, such as coats, into class studios. Additional terms and conditions and/or policies may apply to premium group fitness classes that are not included in your Membership Class. Any questions should be directed to the General Manager.

No Outside Trainers: Use of personal trainers who are not employed by Equinox is strictly prohibited at all Clubs. You may not provide personal training services to, or receive personal training services from, any other member or guest, regardless of whether a fee is charged.

Personal Property: Please do not bring valuables onto Club premises, including but not limited to jewelry, watches, and cash. Personal property, including but not limited to gym bags, backpacks, purses, and coats, are not permitted on the Club floor or in studio spaces. TO THE MAXIMUM EXTENT PERMITTED BY LAW, EQUINOX WILL NOT BE LIABLE FOR THE LOSS OR THEFT OF, OR DAMAGE TO, ANY PERSONAL PROPERTY OF YOU OR YOUR GUESTS, INCLUDING WITHOUT LIMITATION ANY ITEMS LEFT IN LOCKERS, LOCKER ROOMS, SPA TREATMENT ROOMS, STUDIOS, WITH THE COAT CHECK OR ELSEWHERE IN ANY CLUB.

Parking Lot and Parking Garage: Certain Clubs may provide you with access to a parking lot or parking garage which is provided solely for your benefit and convenience and may be operated by Equinox or a third party. Please do not leave valuables in your vehicle. TO THE MAXIMUM EXTENT PERMITTED BY LAW, EQUINOX WILL NOT BE LIABLE FOR THE LOSS OR THEFT OF, OR DAMAGE TO, ANY PERSONAL PROPERTY OF YOU OR YOUR GUESTS, INCLUDING WITHOUT LIMITATION ANY ITEMS LEFT IN YOUR VEHICLE(S) OR THE VEHICLE(S) THEMSELVES.

Service Animals and Pets: Service animals that are individually trained to work or perform tasks for individuals with disabilities (“Service Animals”) are permitted to accompany members (or other Club guests) with disabilities to all areas of the Club open to members. Equinox may ask you to remove your Service Animal if, in Equinox’s discretion, the animal is out of control and you do not take effective action to control it, if the animal is not housebroken, if the animal poses a direct threat to the health or safety of others or if the animal’s behavior otherwise fundamentally alters the nature of the Club’s business. Equinox reserves the right to charge you for any actual damage caused by your Service Animal. Service animals must remain under the member’s control at all times and may not be affixed to any area of the Club including but not limited to equipment. For the safety of our members and the animals, pets and “emotional support animals” are not permitted in any area of our Clubs.

Responsibility to Notify: If an incident occurs at the Club, please notify the General Manager or Assistant General Manager as soon as possible so the matter can be documented and addressed appropriately. When feasible, notice should be provided within twenty-four (24) hours of the incident.

Guests: As part of your membership, you may receive certain privileges to periodically bring a guest to a Club. You must accompany your guest, and all guests will be required to check in at the front desk, present proper photo identification, and sign a Guest Waiver in order to access and use the Club. Guest access is subject to Equinox’s Policies and may require payment of a guest pass fee. Guests may be required to maintain a copy of their photo identification on-file with Equinox in order to verify their identity before entering any Club. Guests must comply with all applicable Equinox Policies while accessing and using a Club. Without limitation to any additional Equinox policies, Equinox reserves the right to, in its discretion, (1) limit the Clubs and/or hours available to guests; (2) limit the number of times any one individual may access Equinox as a guest; and (3) prevent any individual from accessing Equinox as a guest. Guests under the age of sixteen (16) years of age are not permitted.

Children: Children who are at least sixteen (16) years of age may use the Club as a guest. Children fifteen (15) years of age, and under, are not permitted to access any Club, including locker rooms and equipment, unless they are participating in children-specific programming offered by Equinox. You, as a child’s parent or legal guardian, will be required to sign a waiver and release form on behalf of your child before your child may participate in any children’s programming or use the Club as a guest if your child is aged sixteen (16). Children who are sixteen (16) years of age, or older, are required to show identification with proof of age to use the Club as a guest. Equinox reserves the right to maintain a photo or copy or your child’s identification on-file. All youth programs are provided solely as a convenience while you are using a Club and you are strictly prohibited from leaving Club premises while your child is in the Kids’ Club facility, unless otherwise expressly stated. Except when in Kids Club facilities, children must be accompanied by a parent or legal guardian at all times. Any child who is disruptive, unsupervised, sick, or otherwise interfering with the Club’s operations may be prohibited from participating in children’s programming.

Services Rendered by Equinox: Purchases of personal training, nutrition counseling, and Pilates sessions (collectively, “Sessions”), as well as any spa treatments or services (collectively, “Treatments”), constitute the purchase of services to be provided by Equinox, not by any particular trainer, instructor or therapist, and Equinox may change or substitute your trainer, instructor or therapist at any time. For Treatments, if you have specified a gender request for your therapist and Equinox is unable to accommodate that request for the scheduled time, Equinox will work with you to reschedule or, if needed, cancel your Treatment.

Interactions & Expectations: Sessions and Treatments are voluntary activities in which you may elect to participate. You understand and acknowledge that the nature of personal training, Pilates, and spa treatments may require close contact between you and your trainer, instructor or therapist and that he or she may need to touch your body to provide adjustments and guidance as necessary. You may end your Session or Treatment if you feel uncomfortable at any time. If you have any concerns as to how a Session or Treatment was conducted, please raise those concerns immediately with the Club General Manager or Assistant General Manager.

Discounts: Equinox may offer certain discounts for purchasing multiple Sessions and/or Treatments as a package. Any such discounts apply only to the number of Sessions and/or Treatments purchased in the package. Any further or additional Sessions and/or Treatments will be charged at the then-current rate for individual Sessions or Treatments.

Personal Training, Pilates, and Nutrition Counseling:

  • Session Eligibility: Sessions are available only to active members.

  • Session Payment: You are required to pay for Sessionson or before the date of the Session. Equinox may cancel any scheduled Session for which no payment has been received by twenty-four (24) hours prior to the Session. If you use a Session that was not otherwise paid for, Equinox will charge the payment method associated with your account.

  • Session Cancellation Policy: You may cancel or reschedule your Session up to twenty-four (24) hours before the Session is due to start. You will be charged for the full cost of the Session if you cancel or reschedule with less than twenty-four (24) hours’ prior notice or if you fail to show up to your Session. You are not entitled to any refund for or reinstatement of any late-cancelled or missed Session.

  • Expiration of Sessions: All Sessions expire upon the termination of your membership or six (6) months after the date of purchase of the sessions, whichever comes earlier, unless prohibited by law or a different expiration date is expressly stated in writing by Equinox.

  • No Refunds of Sessions: All sales of Sessions are final and non-refundable, except as required by law. Sessions do not constitute gift cards, gift certificates, or similar instruments, have no cash value, and are non-transferable and non-descendible. Sessions may be used only during the term of your membership. If you have any unused Sessions at the time your membership is cancelled, you will not be entitled to a refund except for certain limited circumstances expressly set forth in your Membership Agreement. Fitness programming and results vary by individual, and specific results are not guaranteed.

Spa:

  • Treatment Eligibility: Treatments are available to (i) active members sixteen (16) and older and (ii) non-member eighteen (18) years and older. Any Member under eighteen must (a) maintain a junior membership; (b) have a parent or legal guardian who is also a member; (c) have such parent or legal guardian execute all required waivers and documentation on their behalf; and (d) be accompanied by such parent or legal guardian, who must remain in the treatment room at all times during the Treatment.

  • Booking and Payment: You will be required to provide your credit card information to book an appointment for a Treatment. You must check in at the front desk prior to your Treatment. Equinox will charge the payment information provided for the Treatment(s) in addition to a twenty percent (20%) gratuity or, if such information is invalid, the payment method associated with your account. You may adjust or change the gratuity in person at the Spa or by emailing the Club’s Spa Manager on the date of your Treatment, no later than 8:00 pm local time, based on the Club your treatment was booked. If no action is taken by that time, the twenty percent (20%) non-refundable gratuity will be charged to you.

  • Treatment Cancellation Policy: You may cancel or reschedule your Treatment up to twenty-four (24) hours before the Treatment is due to start. You will be charged for the full cost of the Treatment if you cancel or reschedule with less than twenty-four (24) hours’ prior notice or if you fail to show up to your Treatment. You are not entitled to any refund for or reinstatement of any late-cancelled or missed Treatment.

  • No Refunds of Treatments: All sales of Treatments are final and non-refundable, except as required by law. Treatments have no cash value and are non-transferable and non-descendible. Treatment results vary by individual and specific results are not guaranteed.

  • Expiration of Treatments: All Treatments expire six (6) months after the date of purchase, unless prohibited by law or a different expiration date is expressly stated in writing by Equinox.

Freezing Your Membership: You may temporarily suspend (“Freeze”) your membership if you are medically unable to use any Club or for another statutorily required reason as described in your Membership Agreement. If you are unable to use any Club due to medical reasons, Equinox may require you to provide documentation as described below before granting a request for a Freeze (“Documentation”). For more information on freezing your membership, including for non-medical reasons, please contact your preferred Equinox Front Desk or Equinox Concierge (Concierge@Equinox.com).

Documentation: For certain Freeze requests Equinox may require you to providea signed letter from a licensed physician, physician assistant, advanced practice registered nurse, or another credentialed medical provider. Other forms of proof may be required depending on the Freeze request. If you have any questions on the document(s) required, please contact the Equinox Concierge.

Exclusions: You are not eligible to Freeze if you have a past-due/overdue balance or your membership is otherwise not in good standing with Equinox, if you joined as part of a payroll deducted or subsidized corporate membership program, or if you have a short-term membership.

How to Request a Freeze: You may request a Freeze by any of the methods listed below. Please note, retroactive Freezes are not permitted.

In-person at any Club in your membership class. You will be required to complete a Freeze request form.

By emailing Equinox Concierge at Concierge@Equinox.com.

Ancillary Services Not Frozen: Please note that any locker rental and/or laundry service fees, as well as expiration dates for personal training and Pilates sessions and spa treatments, are not suspended during any Freeze.

No Use of the Club During Freeze: Members are prohibited from accessing or using any Club while their membership is on a Freeze (other than any areas or services open to non-members, such as The Shop or Spa services). If you check-in to any Club while on Freeze, Equinox may revert your membership to active status, without further notice to you, and a prorate of your membership dues will be added to your membership account.

As a benefit of your new membership and otherwise from time to time, Equinox may provide you with certain complimentary or promotional items, including without limitation, complimentary personal training or Pilates sessions, spa treatments or months of membership, or other account credits, or other member rewards (collectively “Complimentary Items”). Complimentary Items are offered at Equinox’s discretion, have no cash value and are non-refundable, non-transferable and non-descendible. Complimentary Items expire ninety (90) days after the date of issuance, unless otherwise expressly stated on a voucher or other written terms and conditions for a Complimentary Item. All applicable Equinox Policies, including without limitation regarding booking and cancellation, apply to your use of Complimentary Items. Credits and/or member rewards provided as a Complimentary Item may be used to purchase ancillary services and eligible retail merchandise, but may not be used towards membership dues, food and beverage purchases or any other third-party services offered at a Club. Complimentary Items may only be redeemed and used while you are a member in good standing and will become null and void upon any cancellation of your membership. Complimentary Items will not be considered in computing the amount of any refund to which you may be entitled upon cancellation of your membership.

Privacy Policy: We use the personal data collected when you interact with Equinox including through the course of your membership (if you are a member), and including but not limited to your access to and use of Clubs, www.equinox.com and/or the EQUINOX-branded mobile app (“Digital Properties”), in an effort to fulfill our commitment to offering and providing unparalleled member service. Please read our current Privacy Policy, available at http://www.equinox.com/privacy (“Privacy Policy”), so that you may understand our privacy practices, including the types of personal data we collect, how we use this personal data and with whom we share it. We may periodically update the Privacy Policy and this summary, in our discretion, to reflect change in our privacy practices, the Digital Properties and applicable law. You should review the Privacy Policy from time to time to familiarize yourself with our current policies.

Videos & CCTV Footage: Members, guests, vendors, visitors of Equinox, and event attendees should be aware that we may capture images and videos, including photographs and CCTV footage, within our Clubs to help maintain a safe and secure environment. Such footage is not shared with members, guests, or external parties except when required by law, pursuant to a subpoena or law enforcement request related to an active investigation, if required by law or subpoena, or as set forth in Equinox’s Privacy Policy.

Marketing Communications: Equinox may use your personal data to provide special offers, promotions and information about Equinox and our service offerings to you. We may also use your personal data to determine if you are eligible for certain offers – for example, discounted membership rates offered to your company’s employees. We may also send you newsletters and information about products, services and promotions of our business partners and affiliates that we think you may find interesting.

Where required by applicable law, we will obtain your consent to send you marketing communications. If you do not wish to receive any marketing emails, you can opt out of future mailings by clicking on the unsubscribe link located at the bottom of the relevant email. If you are a member and have established an account on the Digital Properties, you can also unsubscribe at any time by logging in and adjusting your communications preferences. Although we strive to update our email list as frequently as possible, you might receive another promotional email before we are able to remove you from our lists. If you are a member, please note that even if you opt-out of receiving promotional emails, you will continue to receive administrative and operational communications regarding your membership, such notices regarding billing or club closures, as described above.

How it Works: Equinox members who are in good standing (“Referrer”) may receive a referral reward for referring a friend, family member, or acquaintance to Equinox, subject to the following terms (“Referral Program Terms”).

  • A referral reward will be applied to the Referrer’s account within approximately sixty (60) days after all eligibility requirements are satisfied, including the referred member meeting the minimum membership duration requirement and, if applicable, the Referrer’s completion of their Initial Obligation Period.

  • Referral rewards are determined based on the offer in effect at the time the referred individual joins Equinox. Offers are not locked in at the time a referral is made and may change prior to enrollment. Any rewards in the form of complimentary month(s) are applied as credit toward future membership dues and do not pause, toll, or modify the Initial Obligation Period, and do not have any cash value and are non-transferable.

  • Referral rewards can be viewed in the EQX+ App under “Gift Cards and Rewards”.

  • In addition to the Referral Program Terms, the referral program is governed by the Referrer’s membership agreement, the Equinox Policies, and the EQX+ terms and conditions (collectively, the “Governing Documents”). In the event of any conflict between these Referral Program Terms and the Governing Documents, the Governing Documents will control.

Eligibility to Participate: Referrers must remain in good standing at the time the reward is granted to be eligible to receive it. Members with complimentary, short-term, employee sponsored or junior memberships, and employees of Equinox or its affiliates are not eligible to participate in this program.

Who You Can Refer: Referrers may refer anyone who may be interested in joining Equinox. Referrals are valid only if the referred individual joins Equinox as a new member, regardless of which Club they join, and remain a member for at least 60 days. For purposes of this program, a referred individual is considered a “new member” if they have not been an Equinox member at any time during the twelve (12) months preceding their enrollment date. Member rewards will not be provided for referring any individuals who join with a short-term, junior or employee benefit membership.

Complimentary Items: Any referral rewards earned through the referral program are considered Complimentary Items, as defined in, and subject to the terms in the Equinox Policies and expire 90 days from the date of issuance. Member rewards have no cash value and are non-transferable. The referral program is a voluntary membership perk, and Equinox may, in its sole discretion, modify, suspend, or terminate this program without notice.

Referral Reward (Pre-Sale Members): If the Referrer is a Select member at a club in pre-sale (i.e., the club is not yet open) at the time of referral, and the referred individual joins Equinox with an eligible membership type, the Referrer will receive a referral reward in the form of one (1) complimentary month of membership. The reward will be applied as a credit toward future membership dues following completion of the Referrer’s Initial Obligation Period. No reward will be issued if the referred member cancels or their membership is terminated within sixty (60) days of joining. The complimentary month does not pause, toll, or otherwise modify the Initial Obligation Period, has no cash value, and is non-transferable.

Referrals may not be generated by using any robotic, automated or programmed methods, by engaging in spamming, or by creating a website or other means to solicit referrals from individuals who are not personally known. Equinox reserves the right, in its sole discretion, to deny a referral member reward, permanently disqualify an individual from the referrals program, or terminate the membership of any individual it believed to be tampering with the functioning of or otherwise abusing the referrals program. Further, Equinox may, in its sole discretion, deny or revoke any referral reward, disqualify participants, suspend or terminate memberships where it determines misuse, abuse, or manipulation of the program.
